User Agreement

This is an English translation provided for convenience. In the event of any discrepancy between this text and the Russian original, the Russian version shall prevail.

This User Agreement sets out the terms for using the services of the Nalichniki.com project: the site nalichniki.com, the photo archive foto.nalichniki.com, the shop store.nalichniki.com, and the blog blog.nalichniki.com.

By using the sites, viewing materials, registering, uploading photographs, or placing orders, the user confirms that they have read this Agreement and accept its terms.

1. Definitions

Project Services — the collective sites nalichniki.com, foto.nalichniki.com, store.nalichniki.com, blog.nalichniki.com, and related APIs and components.

Administration — the owner and/or authorized persons providing technical, editorial, and organizational support for the project.

User — any person using the project's services.

Registered User — a user who has created an account on the site.

Materials — photographs, captions, descriptions, information about the place and date of shooting, the author, the object, the building, the settlement, comments, and other information uploaded or submitted by a user.

Photograph — an image uploaded by a user to the site, including the original file, reduced copies, previews, and technical derivative images.

Object — a building, structure, street, settlement, architectural element, museum object, cultural motif, or other entity to which photographs may relate.

2. Purpose of the Project

The Nalichniki.com project was created to collect, systematize, study, and publicly present photographs of wooden architecture, window surrounds ("nalichniki"), and related cultural phenomena.

The photo archive foto.nalichniki.com is intended for:

• viewing and study by users;
• expanding the digital archive;
• scientific, educational, and cultural purposes;
• clarifying the geography, dating, authorship, and condition of objects;
• comparing photographs of the same object taken at different times.

The photo archive is not a commercial stock photo bank and is not intended for the free downloading of photographs for resale, the manufacture of goods, publication in third-party outlets, or other independent commercial use by third parties.

The shop store.nalichniki.com is intended for purchasing publications, goods, and materials related to the project.

3. Registration and Account

A single account is valid across all services of the Nalichniki.com project.

Registration may not be required to view some materials.

Registration may be required to upload photographs, edit information, participate in certain sections of the site, and use some features.

The user undertakes to provide accurate data necessary for the site to function and not to give third parties access to their account.

The user is responsible for actions carried out using their account, unless they prove that access was obtained by a third party through no fault of their own.

The Administration may restrict, suspend, or terminate a user's access in the event of a breach of this Agreement, attempts to damage the site, bulk uploading of false data, abuse of functionality, or other actions that interfere with the operation of the archive.

4. Uploading Photographs and Other Materials

By uploading photographs and other materials to the site, the user confirms that:

• They are the author of the uploaded photographs or otherwise have the legal right to upload them to the site.
• The uploaded materials do not infringe the rights of third parties.
• If recognizable people appear in the photograph, the user has obtained the necessary consents for the disclosure and use of their image, or bears responsibility for having a lawful basis for such publication.
• The materials do not contain information whose dissemination is prohibited by law.
• The user understands that once published, the materials may become available to other users of the site.

The user undertakes not to upload:

• photographs of which they are not the author and for which they do not hold rights of use;
• photographs that clearly violate a person's private life;
• materials containing insults, threats, extremist materials, pornography, unlawful advertising, malicious links, or other prohibited content;
• materials that are deliberately misleading as to the place, date, author, or content of the photograph;
• materials unrelated to the site's subject matter, unless otherwise agreed with the Administration.

The Administration may decline to publish, hide, edit the description of, move, merge, adjust the geographic attribution of, or delete materials that violate this Agreement, do not fit the site's subject matter, contain errors, or require verification.

5. Rights to Photographs and Permission for Use by the Site

Exclusive rights to photographs uploaded by a user remain with their author or other lawful rightsholder.

By uploading a photograph to the site, the user grants the Administration a free, non-exclusive permission to use the uploaded materials within the operation of the Nalichniki.com project, including to:

• store the photographs and related information in the site's database;
• publish the photographs on the site's pages;
• create technical copies, reduced versions, previews, and other derivative files necessary for the site's operation;
• display the photographs in galleries, object cards, author pages, collections, maps, search results, and other sections of the site;
• accompany the photographs with the author's name, place of shooting, date, description, and other information;
• use the photographs in the project's educational, research, and informational materials with attribution, where such attribution is technically possible and known.

This permission is granted for the entire period the materials remain on the site and applies worldwide, since the site is accessible over the internet.

The user may ask the Administration to delete photographs they have uploaded or to change the authorship information. The Administration reviews such requests within a reasonable time.

Removing a photograph from the site's public pages does not always mean the immediate deletion of all technical copies, backups, logs, and derivative files, where their temporary retention is necessary for the technical operation of the site, the protection of the Administration's rights, or compliance with legal requirements.

6. Use of Materials by Other Users

Users of the site may view the site's materials for personal, educational, research, and informational purposes.

Without separate permission from the author or the Administration, the following is not permitted:

• bulk downloading of photographs;
• copying substantial parts of the archive;
• using photographs to manufacture and sell goods;
• publishing photographs in books, articles, media, social networks, catalogs, advertising materials, or on third-party sites, where such use goes beyond quotation and ordinary fair mention;
• removing or distorting information about the author, source, place of shooting, and other accompanying data;
• using automated data-collection tools, parsing, scraping, or circumventing the site's technical restrictions.

To use photographs beyond viewing them on the site, permission must be obtained from the photograph's rightsholder and/or the Administration.

7. Authorship and Attribution

When uploading materials, the user may provide their name, pseudonym, city, website, profile description, and other information supported by the site's interface.

The Administration strives to preserve attribution of photographs where such information was provided by the user.

If a user discovers an error in the attribution, description, date, place of shooting, or the linking of a photograph to an object, they may contact the Administration to have it corrected.

8. Geographic Data, Dates, and Descriptions

The user may provide the site with information about the place of shooting, the date of shooting, the name of the settlement, the address, coordinates, a description of the object, and other data.

The user understands that such information may be published on the site if it is necessary for the operation of the archive.

The Administration may clarify, correct, supplement, or standardize geographic data, dates, settlement names, information about objects, and other descriptive data.

If the exact place of shooting is unknown, the user must state this explicitly and must not present an assumption as a verified fact.

9. Moderation

Materials uploaded by users may undergo prior or subsequent moderation.

Without prior notice, the Administration may:

• decline to publish a material;
• temporarily hide a material;
• delete a material;
• change the caption, category, geographic attribution, or technical information;
• merge photographs relating to the same object;
• split materials that were merged in error;
• restrict a user's ability to upload or edit materials.

Moderation is carried out to maintain the quality of the archive, protect the rights of authors and third parties, ensure compliance with the law, and preserve the thematic integrity of the site.

10. Personal Data

When using the project's services, the Administration may process data necessary for registration, authorization, order placement, uploading materials, communicating with the user, protecting the site, and maintaining the archive.

Such data may include: email address, name or pseudonym, profile information, technical connection data, information about uploaded materials, order history, the date and time of actions on the site, IP address, cookies, and other technical data.

The processing of personal data is governed by a separate document — the Personal Data Processing Policy.

11. Photographs Depicting People

The user must exercise particular care when uploading photographs in which recognizable people appear.

If a person is depicted in a photograph, the user confirms that they have obtained the necessary consents for the publication and further use of that image, or that such publication is permitted by law without separate consent.

The Administration may delete or hide a photograph depicting a person at the request of the person depicted, their legal representative, or another person with a legitimate interest.

The site is dedicated to wooden architecture, window surrounds, and objects of the cultural environment; photographs of people should therefore be uploaded only when they are relevant to the archive's subject matter and do not infringe the rights of the people depicted.

12. User Liability

The user is solely responsible for:

• the lawfulness of the materials uploaded;
• holding the rights to the photographs;
• the accuracy of the information provided;
• compliance with the rights of third parties;
• obtaining the consent of people depicted, where such consent is required;
• the consequences of uploading materials to the site.

If claims, demands, or lawsuits related to the user's materials are brought against the Administration, the user undertakes to assist in resolving such claims and to compensate for any losses caused, in cases provided for by law.

13. Administration Liability

The Administration makes reasonable efforts to keep the services operational, preserve materials, and ensure the accuracy of information, but does not guarantee uninterrupted or error-free operation of the sites.

The sites and their materials are provided "as is."

The Administration is not liable for:

• temporary unavailability of the sites;
• errors made by users when uploading materials;
• inaccurate information provided by users;
• actions of third parties who copied the site's materials in violation of this Agreement;
• the impossibility of fully preventing unauthorized copying of images from the internet.

The Administration may change the structure, design, and functionality of the sites, the rules for uploading materials, the moderation procedure, and the composition of available sections.

14. Removal of Materials and Requests from Rightsholders

If a user, author, rightsholder, person depicted, or other interested party believes that a material on the site infringes their rights, they may contact the Administration.

The request should preferably include:

• a link to the disputed material;
• the substance of the claim;
• confirmation of authorship, rights, or other legitimate interest;
• contact details for a response;
• the desired action: deletion, correction of attribution, change of description, hiding the photograph, or clarification of data.

The Administration reviews requests within a reasonable time and may ask for additional information.

15. Restrictions on Automated Data Collection

The use of robots, scripts, parsers, bulk downloaders, automated download tools, or means of bypassing the site's interface or extracting data is prohibited without the Administration's written permission.

Actions that place an excessive load on the site, interfere with its operation, or are aimed at gaining unauthorized access to data are prohibited.

16. Changes to the Agreement

The Administration may amend this Agreement.

A new version takes effect from the moment it is published on the site, unless a different date is specified in the new version itself.

Continued use of the sites after a new version is published constitutes the user's agreement to the amended terms.

18. Final Provisions

If any provision of this Agreement is found to be invalid, this does not affect the validity of the remaining provisions.

Relations arising from the use of the site are governed by the law of the Russian Federation, unless otherwise provided by mandatory provisions of applicable law.

This Agreement governs only the terms of use of the project's sites and does not replace separate documents required for processing personal data, obtaining consents, or formalizing other legally significant relations.
